What is a manifestation determination review?
A manifestation determination review, often called an MDR, is a meeting that is required once a child with an IEP has been removed from class for more than 10 days in a school year.
The purpose is to decide whether the behavior was directly related to the child’s disability or whether the behavior happened because the school failed to properly implement the child’s IEP.
This matters because the answer can affect what discipline the school may impose and what steps the school must take next.
Parents should not treat the MDR as a routine school meeting. The outcome can affect the child’s services, placement, school record, and next steps.

- what the school says happened
- what discipline the school is proposing
- how the behavior connects to your child’s disability
- whether behavior supports were in place
- whether the school followed the IEP
- whether evaluations or behavior assessments are needed
- whether there is a pattern of incidents that warrant IEP or BIP amendments or placement discussions

If your situation is a fit, the next step may be a Strategy Session or Document Review Strategy Session.
If you opt for a Document Review Strategy Session, the attorney will review specific documents before the Strategy Session. We will then have a Strategy Session.
During the Strategy Session, whether you opted for document review or not, you meet with an attorney who reviews your concerns, identifies key legal issues, and explains your options. After the session, you receive a written Action Plan with recommended next steps, questions to ask, and strategies for moving forward. If you opted for a document review, the Action Plan will include comments on the documents that were reviewed.
For manifestation determination or school discipline matters, your Action Plan will help clarify what records to gather, what issues to raise, what questions to ask at the meeting, and what options may be available after the school makes a decision.

Some families only need a Strategy Session and written Action Plan before an IEP meeting. Others may need additional representation.
During the Strategy Session, the attorney will discuss the types of support Shefter Law can provide. The right level of support depends on your child’s needs, the school issues, the timeline, and the path you choose to take.
