Serving Children with Disabilities during the Covid-19 Pandemic

MSDE issued a Technical Assistance Bulletin #20-01 regarding servicing children with disabilities during COVID 19.  In a nutshell, schools still have to provide services and IDEA timelines are not tolled. These means, all evaluations and meetings need to be held within the legal timelines whether school is in session or not. 

Schools should work with parents to develop a plan during distant learning. The most interesting point is that once school is back in session, the IEP team should meet to discuss whether compensatory education is warranted.  Compensatory education is warranted if there is a total lack of progress or minimal progress toward IEP goals.    

What can you, as the parent do?  For now, collect data.  Read your child’s IEP; see what the goals are; know what the expectations are.  Collect data specific to those goals and expectations.  Once school is back in session, request an IEP meeting to determine whether compensatory education is warranted.  If the school gives you push back, call me at 301-605-7303 or email me at frances@shefterlaw.com to discuss how I can help.
